By accessing this website and/or purchasing products from Broken K Farms (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or purchase our products.

By placing an order, you confirm that you are at least 18 years old.

2. Products Sold

We sell fertile hatching eggs for poultry breeding and incubation purposes only. Eggs are not sold for human consumption unless explicitly stated.

All eggs are collected from healthy, properly maintained breeding stock; however, hatchability and performance cannot be guaranteed due to variables beyond our control.

3. No Hatch Guarantee

Hatching eggs are fragile and perishable. Hatch rates depend on numerous factors, including but not limited to:

  • Shipping conditions and handling

  • Incubation equipment accuracy

  • Temperature and humidity control

  • Incubation experience

  • Environmental conditions

We do not guarantee hatch rates. By purchasing, you acknowledge and accept these risks.

4. No Returns / No Refunds on Shipped Eggs

All sales of hatching eggs are final once shipped.

Due to biosecurity, perishability, and handling risks:

  • We do not accept returns of hatching eggs.

  • We do not provide refunds for poor hatch rates.

  • Minor cracks, detached air cells, or reduced hatchability caused by shipping stress are not grounds for refund.

In the event of significant shipping damage, customers must notify us within 24 hours of delivery and provide photographic evidence. Any compensation is at our sole discretion.

5. Shipping Policy

We ship via third-party carriers (e.g., USPS, UPS, FedEx). Once an order is transferred to the carrier:

  • We are not responsible for delays, mishandling, or damage caused during transit.

  • Delivery timelines are estimates only and not guaranteed.

  • Customers are responsible for providing accurate shipping information.

We are not liable for packages marked “delivered” by the carrier.

6. Order Cancellations

Orders may be canceled only before shipment. Once shipped, orders cannot be canceled, refunded, or modified.

We reserve the right to cancel any order at our discretion.

7. Limitation of Liability

  • Incidental or consequential damages

  • Lost profits or lost livestock

  • Emotional distress related to hatch failure

8. Biosecurity & Animal Health

Customers are responsible for maintaining proper biosecurity practices. We are not liable for issues arising from improper flock management, disease transmission, or improper quarantine procedures after hatch.

9. Intellectual Property

All content on this website, including logos, text, photos, and branding, is the property of Broken K Farms and may not be reproduced without written permission.

10. Governing Law

These Terms shall be governed by the laws of the State of MS, without regard to conflict of law principles.


11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of the revised Terms.
